Two married state employees couldn’t convince the First Circuit to revive free speech whistleblower claims that Puerto Rico’s workers’ compensation agency retaliated against them after the husband reported multiple violent disputes with his coworkers.
A complaint about “personal animosity between coworkers” doesn’t implicate the First Amendment because it’s a private, not public, matter, the U.S. Court of Appeals for the First Circuit said Friday. Additionally, the plaintiffs didn’t sufficiently allege the incident reports were a substantial or motivating factor in the adverse employment actions.
